OFFICIAL SKILL CONTEST RULES

 

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THIS SKILL CONTEST.  A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING.  VOID WHERE PROHIBITED BY LAW.

 

THIS SKILL CONTEST IS OPEN ONLY TO LEGAL RESIDENTS OF THE UNITED STATES, EXCEPT ARIZONA, 18 YEARS OF AGE OR OLDER, WHO ARE REGISTERED MEMBERS OF WWW.FUNNIESTJOKESTER.COM, AND WHO MEET THE OTHER ELIGIBILITY REQUIREMENTS SET FORTH IN SECTION 4 BELOW.  BY ENTERING THIS SKILL CONTEST, EACH ENTRANT CERTIFIES THAT HE/SHE MEETS ALL ELIGIBILITY REQUIREMENTS AND AGREES TO ACCEPT AND BE BOUND BY ALL TERMS OF THESE OFFICIAL SKILL CONTEST RULES ("OFFICIAL RULES).

 

1.  Sponsor:  This $10,000 Funniest Joke Competition (the "Skill Contest) is sponsored by TheReelComic, LLC ("Sponsor"), a limited liability company with its principal offices at 500 W. Putnam Avenue, Suite 400, Greenwich, Connecticut  06830.  Sponsor operates a website by which it conducts contests where competitors compete to determine who can tell the funniest joke.

 

2.  Contest Dates:  The Skill Contest begins on April 1, 2010 at 12:00:01 a.m. and ends on April 30, 2011 at 12:00:00 midnight (the "Skill Contest Period").  During the Skill Contest Period there will be a series of eleven (11) month-long tournament competitions involving judging of joke video submissions which start and end as described in these Official Rules.  In these Official Rules, all times are local times in Connecticut, USA.

 

3.  Consumer Disclosure; Description of the Prize:  One prize will be awarded in this Skill Contest.  The winner of the Champions Round competition will receive a check from Sponsor in the amount of ten thousand dollars ($10,000.00) (the "Prize") and that is the aggregate retail value of all prizes to be awarded.

 

4.  Eligibility:  (a) Participation in this Skill Contest is open only to individuals who, at the time of entry, were:  (i) eighteen (18) years of age or older; (ii) legal residents of one of the United States, except Arizona, or the District of Columbia; and (iii) registered members of FunniestJokester.com ("Members").  No purchase, fee or other payment is required in order to become a Member of FunniestJokester.com.

 

(b)  Notwithstanding the foregoing, the following persons are NOT ELIGIBLE to participate in this Skill Contest:  (i) employees, officers, directors and agents of Sponsor and/or Sponsors licensees ("Sponsor Agents"); (ii) parents, spouses, children, brothers and sisters of Sponsor Agents; and (iii) individuals living in the same household as Sponsor Agents.

 

(c)  Each entrant is responsible for providing an accurate email address and for frequently checking for email messages from Sponsor.  Sponsor will not be responsible for email messages sent that are not viewed by the recipient in a timely manner.  Individuals that provide information reasonably determined by Sponsor (in its sole discretion) to be incomplete, false or deceptive, will be ineligible to participate or (if they have already participated) to win the Skill Contest.

 

5.  How to Enter:  To enter, an eligible individual must submit a digital file video recording (a "Joke Video") of himself/herself telling a joke, including with such submission, his/her email address.  The Joke Video must be uploaded to the Sponsor's website, www.FunniestJokester.com (hereinafter, "Sponsor's Website"), by following the instructions posted there.  Eligible individuals may enter as often as they wish, but each entry requires a unique Joke Video. 

 

6.  Joke Video Technical Requirements:  (a)  To be accepted, each Joke Video must meet the following requirements:

 

(1)  Video formats:  Sponsor will accept video files from most digital cameras, camcorders and cell phones in the following file formats:  .wmv, .avi, .mov and .mpg.  Sponsor shall be under no obligation to upgrade or otherwise modify its systems to accommodate Joke Videos not immediately compatible with Sponsors systems.

 

(2)  Maximum file size:  20 MB.

 

(3)  Maximum running time:  four (4) minutes, including any trailer and any credits.  If a Joke Video is longer than this, only the first four (4) minutes will be posted for public view and subject to evaluation.

 

(4)  Language:  English only.

 

(b)  Entries not submitted in accordance with (i) the foregoing requirements, (ii) any additional requirements and instructions provided by Sponsor on Sponsor's Website, and/or (iii) the terms and conditions in these Official Rules, will not be considered, and if made available for public view and evaluation and later found out by Sponsor to be not in compliance with any of the foregoing, may be removed by Sponsor in its sole discretion.

 

7.  Entrants Certification as to His/Her Joke Video:  (a)  By entering, each entrant represents and warrants that he/she meets the eligibility criteria set forth in Section 4 and that his/her Joke Video (and each element thereof):  (i) complies with these Official Rules and the Terms of Use of Sponsors Website; (ii) is the original work of the entrant; (iii) does not infringe or violate the intellectual property rights or other rights of any third party, including but not limited to rights of copyright, trademark, service mark, patent or trade secret, contract rights, licensing rights, rights of publicity or privacy, moral rights, or any other intellectual property rights; (iv) is not subject to any restrictions and/or licensing requirements contained in any agreements involving third parties and, without limiting the scope of the foregoing, will not cause or obligate Sponsor to pay any fees or other charges to any person or entity in connection with its use, display, performance or other exploitation; (v) is not subject to any restriction, filing or notification obligation, and/or any requirement that a license, permit or authorization be obtained from any governmental entity in connection with the use, display, performance or other exploitation of the Joke Video; (vi) has not previously been published in any medium or won an award or prize of any kind; (vii) does not contain any content that is likely to be considered by a United States resident of reasonable sensibilities as offensive or likely to adversely affect the name, reputation or goodwill of Sponsor and/or any Sponsor Agent, any specific individual, company, business or association, or any particular group, class or race of individuals, as determined by Sponsor in its sole discretion.  Sponsor reserves the right to verify the legitimacy of any submitted releases or permissions or to require that a release form (satisfactory to Sponsor in its sole discretion) be executed and returned within two days notification.  If the appropriate form(s) required by Sponsor are not received as directed, the entry and submitted Joke Video will be disqualified. 

 

(b)  Sponsor reserves the right to disqualify any entries that, in Sponsor's sole discretion, (i) include trademarks, logos, or copyrighted material not owned by entrant or used without permission (such as company names, music, photographs, works of art or images published on or in websites, television, movies or other media); (ii) use individuals names, in whole or in part (including the entrants last name) without submitted express permission; (iii) refer to public figures; (iv) contain vulgar language, profanity, sexual content, content promoting the use of tobacco, alcohol, illegal drugs, firearms or weapons, content expressing or fomenting hate of any kind (including racism or sexism), content that promotes violence or harm to other living creatures, or any other offensive, obscene or inappropriate content; (v) promote a political agenda regardless of the political affiliation and regardless of Sponsor's treatment of other entries that may or may not promote a political agenda; (vi) misrepresent, defame or contain disparaging remarks about other people or companies; or (vii) contain materials embodying the names, likenesses, photographs or other identifying elements of any person, living or dead, without submitted express written permission.

 

(c)  Only individuals may submit Joke Videos.  Joke Videos that purport to be submitted by a group will not be accepted.  (Where a Joke Video is the product of the time and talent of multiple different individuals, only one individual may be considered to have produced and submitted the Joke Video.) 

 

8.  The Month-Long Tournament Competitions:  (a)  Upon submission, each Joke Video shall be posted at Sponsor's Website in the general community. 

 

(b)  While in the general community, and later, if in a Tournament Competition or in the Champions' Round, (i) a Joke Video shall be available for viewing and (if they so choose) evaluation and/or sharing by visitors (whether or not Members) to Sponsor's website; and (ii) Sponsor will collect and maintain the following statistical information regarding the Joke Video:  the total number of times the Joke Video was viewed (i.e., clicks on the Joke Video); the total number of times the Joke Video was evaluated; the average evaluation score of all evaluations of the Joke Video; and the sum of all evaluation scores given to the Joke Video by all evaluators.  Visitors to Sponsor's Website can view a Joke Video as many times as they wish, but only one evaluation per Joke Video per competition period is permitted from each IP address. 

 

(c)  Evaluators may score Joke Videos in the general community on the basis of how funny they are, using a scale from one (1) to five (5), with one (1) being the least funny and five (5) being the funniest.  In determining their scoring, evaluators are instructed to consider the following three sub-criteria:  Originality, Content, Delivery.

 

(d)  Prior to the first day of the calendar month, starting with May, 2010 and continuing through and including March, 2011, Sponsor will select the sixteen (16) Joke Videos in the general community that have the highest average scores, provided that a Joke Video will not be eligible for selection if (i) it has not received at least one percent (1%) of the aggregate number of evaluations for all Joke Videos over the course of the prior month, or (ii) it is competing or has previously competed in a Tournament Competition or other competition conducted by Sponsor.  The sixteen (16) selected Joke Videos shall compete in that month's "Tournament Competition."  In the case of a tie, the Joke Video with the most visits ("clicks") shall be the winner, and if a tie remains after considering the number of visits, the winner shall be determined by Sponsor's judges, using the criteria set forth in Section 8(c).  A Joke Video that has not become eligible to enter a Tournament Competition by the end of February, 2011 will not be eligible to participate in a Tournament Competition or any other competition in this Skill Contest.

 

(e)  Each Tournament Competition will last from 12:00:01 a.m. on the first day of the applicable calendar month until midnight on the last day of the applicable calendar month.  THE FIRST MONTH-LONG TOURNAMENT COMPETITION WILL START AT 12:00:01 A.M. ON MAY 1, 2010.

 

(f)  Each month-long Tournament Competition shall run as follows: 

 

(1)  Prior to the start of the Tournament Competition, each of the competing Joke Videos shall be "seeded" in a manner similar to the manner used in many tournaments involving athletic competition -- i.e., the Joke Video with the highest average evaluation score among the sixteen (16) selected Joke Videos will be paired in head-to-head competition against the Joke Video with the lowest average evaluation score; the Joke Video with the second highest average evaluation score will be paired in competition against the Joke Video with the second lowest average evaluation score, and so on (using the tie-breaking procedure described in Section 8(d) when necessary).  See Figure 1 below where this is set forth graphically in detail.

 

(2)  At the start of the Tournament Competition, the competing Joke Videos will be placed on a different web page or otherwise designated as being "in Tournament Competition."  (They will also remain in the general community.)

 

(3)  In Tournament Competition, evaluators shall consider the head-to-head pairings of Joke Videos and (if they so choose) decide (i.e., "vote") which of the paired Joke Videos is funnier, considering the following three sub-criteria:  Originality, Content, Delivery.  Evaluators will be asked to indicate their votes by clicking the appropriate place on the web page.  Section 8(b) shall apply.

(4)  The eight (8) Joke Videos that, at the end of the seventh (7th) day of the calendar month of the Tournament Competition, were voted funnier (i.e., received a majority of the votes) than the Joke Videos against which they were paired in head-to-head competition (using the tie-breaking procedure described in Section 8(d) when necessary) shall remain in Tournament Competition, and the other eight (8) shall remain in the general community and shall not be eligible to enter Tournament Competition again.  Each Joke Video remaining in Tournament Competition shall then compete head-to-head against the winner of the bracket immediately adjacent to them.  (See Figure 1 above.)

 

(5)  The four (4) Joke Videos that, at the end of the fourteenth (14th) day of the calendar month of the Tournament Competition, were voted funnier (i.e., received a majority of the votes) than the Joke Videos against which they were paired in head-to-head competition (using the tie-breaking procedure described in Section 8(d) when necessary) shall remain in Tournament Competition, and the other four (4) shall remain in the general community and shall not be eligible to enter Tournament Competition again.  Each Joke Video remaining in Tournament Competition shall then compete head-to-head against the winner of the bracket immediately adjacent to them.  (See Figure 1 above.)

 

(6)  The two (2) Joke Videos that, at the end of the twenty-first (21st) day of the calendar month of the Tournament Competition, were voted funnier (i.e., received a majority of the votes) than the Joke Videos against which they were paired in head-to-head competition (using the tie-breaking procedure described in Section 8(d) when necessary) shall remain in Tournament Competition, and the other two (2) shall remain in the general community and shall not be eligible to enter Tournament Competition again.  The two (2) Joke Videos remaining in Tournament Competition shall then compete head-to-head against each other.

 

(7)  The Joke Video that, as of midnight on the last day of the calendar month of the Tournament Competition, was voted funnier (i.e., received a majority of the votes) than the Joke Video against which it was paired in head-to-head competition (using the tie-breaking procedure described in Section 8(d) if necessary), shall be the winner of that month's Tournament Competition (a "Tournament Winner") and shall participate in the Champions' Round.  Both Joke Videos shall remain in the general community and shall not be eligible to enter Tournament Competition again.

 

9.  The Champions' Round:  On the first day of the calendar month after the last Tournament Competition Ð i.e., on April 1, 2011 Ð each of the eleven (11) Joke Videos that were Tournament Winners along with the five (5) Joke Videos that were winners of Sponsor's monthly competitions from 2009 (a total of sixteen (16) Joke Videos), will participate in the "Champions' Round" of competition.  The Champions' Round shall be conducted as follows:

 

(1)  Prior to the start of the Champions' Round of competition, each of the sixteen (16) competing Joke Videos shall be "seeded" in the same manner as that described in Section 8(f)(1), except that the seeding shall be determined by Sponsor's judges, who shall evaluate each of the Joke Videos using the criteria set forth in Section 8(c).  The Joke Video with the highest average evaluation score determined by Sponsor's judges will be paired in head-to-head competition against the Joke Video with the lowest average evaluation score; the Joke Video with the second highest average evaluation score will be paired in competition against the Joke Video with the second lowest average evaluation score, and so on.  See Figure 1 above.

 

(2)  At the start of the Champions' Round of competition, the competing Joke Videos will be placed on a different web page or otherwise designated as competing "in the Champions' Round."  (They will also remain in the general community.)

 

(3)  In the Champions' Round, like the Tournament Competitions, evaluators shall consider the head-to-head pairings of Joke Videos and (if they so choose) decide (i.e., "vote") which of the paired Joke Videos is the funniest, considering the following three sub-criteria:  Originality, Content, Delivery.  Evaluators will be asked to indicate their votes by clicking the appropriate place on the web page.  Section 8(b) shall apply.

 

(4)  The Champion's Round will be conducted in the same manner as each Tournament Competition (see Sections 8(f)(4) Ð (7)), except that the Joke Video that, as of midnight on the last day of the calendar month of the Champions' Round, was voted funnier (i.e., received a majority of the votes) than the Joke Video against which it was paired in head-to-head competition (using the tie-breaking procedure described in Section 8(d) if necessary), shall be the winner of the Champions' Round and shall be the winner (subject to these Official Rules) of the $10,000 Prize.  Both Joke Videos shall remain in the general community and shall not be eligible to enter a Tournament Competition (or Champions' Round) again.

 

10.  Notification of the Winner and Prize Claim Procedure:  (a)  The potential Prize winner will be notified by email within five (5) days after the end of the Champions' Round of competition.  The potential Prize winner will be sent and required to complete, sign and return via facsimile or email (by .pdf attachment) within seven (7) days of attempted notification, the following documents (hereinafter, the "Prize Claim Documents):  (i) an Affidavit of Eligibility and Liability Waiver; and (ii) where lawful, a Publicity Release.  The original, unmodified, completed and signed Prize Claim Documents must be returned to Sponsor by mail, to Sponsor's address set forth above, within fourteen (14) days of attempted notification.  If the Prize Claim Documents sent to the potential Prize winner by any means are returned as undeliverable, or if the potential Prize winner fails or refuses to properly complete, sign and return all Prize Claim Documents within the above-stated time periods, or if the potential Prize winner is determined by Sponsor (in Sponsor's sole discretion) to be ineligible or not in compliance with these Official Rules, the potential Prize winner will be disqualified and the participant whose Joke Video came in second in the Champions' Round of competition will be selected as the potential Prize winner.  If that participant fails or refuses to properly complete, sign and return all Prize Claim Documents within seven (7) days after attempted notification, or if the potential Prize winner is determined by Sponsor (in Sponsor's sole discretion) to be ineligible or not in compliance with these Official Rules, the participant who lost in the semi-final round of competition by the smallest margin will be selected as the potential Prize winner.  Next in line for the Prize shall be the other participant who lost in the semi-final round of the Champions' Round. 

 

(b)  Except where prohibited by law, Sponsor may announce and publish the name, home city and state of the potential Prize winner online on Sponsor's Website.  In the event that a potential Prize winner is disqualified for any reason, Sponsor will award the Prize to the next qualified participant in accordance with the procedure described in Section 10(a) even if the disqualified potential Prize winner's name already has been announced and published online.

 

(c)  The Prize winner must provide in the Prize Claim Documents his/her U.S. social security number (if he/she is a US taxpayer) so that Sponsor can issue an IRS form 1099 to him/her.

 

11.  License of Rights to Joke Videos:  (a)  All Joke Videos submitted, become the property of Sponsor and will not be acknowledged or returned.

 

(b)  By entering this Skill Contest, each entrant grants to Sponsor and its licensees (if any) the irrevocable, perpetual, royalty-free, non-exclusive, transferable and sublicenseable right and license to use, display, copy, edit, modify, create derivative works of, publish, distribute and otherwise exploit the content of and elements embodied in his/her submitted Joke Videos in any and all media, including but not limited to digital and electronic media, audio and audiovisual media (whether now existing or hereafter devised), in any language, throughout the world, and in any manner, for trade, advertising, promotional, commercial, or any other purposes without further approval or consideration.  

 

12.  Grant of Rights by Entrants:  By entering this Skill Contest, each entrant grants Sponsor and its licensees the right to use the entrant's name, image, likeness, voice, photograph, statements and/or Prize information, and/or any portion of any of the foregoing, for promotional, advertising and/or publicity purposes in any media, now or hereafter known, throughout the world and in perpetuity, without compensation or notice to, or further consent of, the entrant, to the extent permitted by law. 

 

13.  Waiver and Release of Liability by Entrants:  (a) By entering this Skill Contest, each entrant, on behalf of himself/herself and his/her heirs, successors, assigns, agents and representatives, and without further compensation of any kind, waives and releases Sponsor and the Sponsor Agents, and each of their successors and assigns, from any and all claims that he/she may now or hereafter have in any jurisdiction based on "moral rights" or unfair competition with respect to Sponsor's and/or Sponsor's licensees exploitation of Joke Videos, and each entrant agrees not to instigate, support, maintain, or authorize any action, claim, or lawsuit against Sponsor and/or any Sponsor Agents, any of their heirs, successors, assigns, agents and/or representatives, and/or any other person, in connection with this Skill Contest, the award, acceptance, possession, use or misuse of any Prize and/or on the grounds that any use of any Joke Video, or any derivative works thereof, infringes or violates any rights of entrant therein. 

 

(b)  Neither Sponsor nor any of the Sponsor Agents shall have any obligation, responsibility or liability with respect to:  (i) notifications, communications or materials sent from an entrant to Sponsor or from Sponsor to an entrant, that are lost, late, misdirected, garbled, inaccurate, incomplete, illegible, unintelligible, damaged or otherwise not received by the intended recipient, in whole or in part, due to computer, post office or technical error of any kind, (ii) telephone, electronic, hardware, software, network, Internet or computer malfunctions, failures or difficulties, (iii) power-related or weather-related events of any kind, and/or to any events not under Sponsor's direct control, (iv) entries or other communications from entrants that contain inaccurate information or do not comply with these Official Rules, (v) errors, omissions, interruptions, deletions, defects, delays in operation or transmissions, theft, destruction, unauthorized access or alterations by entrant or third parties, and/or (vi) any damage to entrant's computer system that occurs in connection with accessing Sponsor's Website and/or submitting a Joke Video.

 

(c)  BY ENTERING THE SKILL CONTEST, EACH ENTRANT, ON BEHALF OF HIMSELF/HERSELF AND HIS/HER HEIRS, SUCCESSORS, ASSIGNS, AGENTS AND REPRESENTATIVES, RELEASES SPONSOR, EACH SPONSOR AGENT, AND EACH OF THEIR RESPECTIVE SUCCESSORS AND ASSIGNS, FROM AND OF ANY AND ALL CLAIMS AND DAMAGES ARISING OUT OF THEIR PARTICIPATION AND/OR ENTRY IN THIS SKILL CONTEST AND/OR THE AWARD, ACCEPTANCE, POSSESSION, USE OR MISUSE OF ANY PRIZE AWARDED IN THIS SKILL CONTEST.

 

(d)  Waiver of California Civil Code Section 1542.  Further, entrants are advised that California Civil Code ¤ 1542 provides that:  A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE CREDITOR DOES NOT KNOW OR SUSPECT TO EXIST IN HIS FAVOR AT THE TIME OF EXECUTING THE RELEASE, WHICH IF KNOWN BY HIM MUST HAVE MATERIALLY AFFECTED HIS SETTLEMENT WITH THE DEBTOR.  By entering this Skill Contest, each entrant, on behalf of himself/herself and his/her heirs, successors, assigns, agents and representatives, acknowledges that he/she understands the significance and consequences of California Civil Code ¤ 1542 and, to the extent it may be applicable, elects to waive the benefits of its provisions, with the intent that the releases and waivers of liability in Sections 13(a), (b) and (c) shall include claims known or unknown, and unknown and unsuspected.

 

14.  Tampering:  (a)  Sponsor, in its sole discretion, reserves the right to disqualify and prohibit from participating any person, who Sponsor determines (in its sole discretion) is or is attempting to:  (i) tamper with Sponsor's Website and/or any part of the Skill Contest; (ii) attempting to undermine the legitimate operation of the Skill Contest by cheating, deception, or other unfair playing practices, (iii) intending to annoy, abuse, threaten or harass any other participants, Sponsor or Sponsor's Agents; and/or (iv) otherwise violating these Official Rules or the Terms of Use of Sponsor's Website.

 

(b)  ANY ATTEMPT TO DELIBERATELY DAMAGE SPONSOR'S WEBSITE (OR ANY PART THEREOF) OR UNDERMINE THE OPERATION OF THIS SKILL CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS.  SHOULD ANY SUCH ATTEMPT BE MADE, SPONSOR AND ITS LICENSEES (IF ANY) RESERVE THE RIGHT TO SEEK DAMAGES AND ANY OTHER AVAILABLE REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR ANY SUCH ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.  EACH ENTRANT AGREES TO INDEMNIFY AND HOLD HARMLESS THE SPONSOR AGENTS FROM AND AGAINST ANY AND ALL CLAIMS, LOSSES, DAMAGES AND/OR LIABILITIES (INCLUDING REASONABLE ATTORNEYS' FEES AND EXPENSES) THAT MAY BE ASSERTED AGAINST OR INCURRED BY ANY OF THEM AT ANY TIME, IN CONNECTION WITH ENTRANT'S JOKE VIDEO, OR THE USE THEREOF, AND/OR BY ENTRANT'S BREACHES OF ANY REPRESENTATION, WARRANTY OR COVENANTS ASSOCIATED WITH THIS SKILL CONTEST.

 

15.  Sponsor's Right to Terminate this Skill Contest:  If, in Sponsor's opinion, there is any suspected or actual evidence of fraud, electronic or non-electronic tampering or unauthorized intervention with any portion of this Skill Contest, or if fraud or technical difficulties of any sort (e.g., computer viruses, bugs) compromise the integrity of the Skill Contest, the Sponsor reserves the right to void suspect Joke Video submissions and/or evaluations and/or terminate the Skill Contest and award the Prize in its sole discretion.  The use of any automated launching or entry software or any other mechanical or electronic means that permits the participant to automatically enter or evaluate repeatedly is prohibited.  In the event of a dispute as to the identity of an entrant based on an email address, the entry in question may be disqualified subject to the Judges discretion.

 

16.  Identification of the Winner:  To the extent permitted by law, the Prize winner's name, city and state of residence may be obtained by sending a self-addressed, stamped envelope, sixty (60) days after the last day of the Champions' Round of competition to:  The Reel Comic, 500 W. Putnam Avenue, Suite 400, Greenwich, Connecticut  06830.  Please specify "10,000 Funniest Joke Competition on the envelope.  Only one request per envelope.  Such information will be available only for one (1) year after the award of the Prize.

 

17.  General Terms:  (a)  This Skill Contest is subject to these Official Rules and is governed by the laws of the State of Connecticut without reference to it rules concerning conflicts or law.  By entering, each entrant agrees to comply with these Official Rules, the Terms of Use of Sponsor's Website and the Sponsor's Privacy Policy posted at http://thereelcomic.com/privacy.php.  Any claims relating to this Skill Contest must be resolved in the state or federal courts of Connecticut.

 

(b)  BY ENTERING, ALL ENTRANTS AGREE TO BE BOUND BY THE DECISIONS OF SPONSOR, THE JUDGES AND THE PUBLIC EVALUATORS, RESPECTIVELY, WHERE THEY PLAY A ROLE IN THIS SKILL CONTEST.  ALL SUCH DECISIONS ARE FINAL AND BINDING.

 

(c)  In order to validly enter and in order to claim a Prize, entrants are required to provide Sponsor with certain personally identifiable information ("PII") such as name, residential address, telephone number, email address and/or other contact information.  Such information may be used for the purposes set forth in the Sponsor's Privacy Policy, located at http://thereelcomic.com/privacy.php, in accordance with the terms set forth in that Privacy Policy.  Entrants wishing that the Sponsor not contact them via postal mail, electronic mail and/or by telephone (except in connection with this Skill Contest and/or as otherwise set forth in the Privacy Policy) may elect to opt-out of such disclosures (i.e., they may direct Sponsor not to make those disclosures other than those as to which "opting out" is not permitted) by following the procedure set forth in Sponsor's Privacy Policy (except that contact shall be permitted in connection with this Skill Contest and as permitted or required by law).

 

(d)  The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision.  In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. 

 

(e)  All taxes, fees and surcharges on the Prize are the sole responsibility of the Prize winner.  In the event that the selected winner of the Prize is ineligible or refuses the Prize, the Prize will be forfeited and Sponsor, in its sole discretion, may choose whether to award the Prize to another entrant in the Skill Contest.
